These Terms and Conditions of Use shall govern the relationship between you, the user of the Service, and (Pinoy Central) Pinoy NZ, as the provider of the service through its website: pinoycentral.com
These Terms are effective as of 1st of July 2019, and by accessing the website and the services associated with it (the “Service”), you hereby agree to be bound by the provisions of these Terms. Do not access or use the Service if you do not agree to be bound by the Terms. We reserve the right to change these Terms at any time and to notify you by posting an updated version of these Terms on the Website. It is your responsibility to regularly review these Terms and your continued use of the Service after any such change has been posted constitutes your consent and acceptance of this change.
Overview. The Service allows people to remit money to the Philippines to a nominated beneficiary. The Service utilises a platform that allows its customers to submit remittance requests online 24-hours a day, 7-days a week. This platform is accessible on the internet through its web address: pinoycentral.com
Registration. To have access to the Service, you must first register online. You must be at least 18 years old at the time of registration. You are required to supply a personally-owned active NZ mobile phone, a valid personal email address and a login password upon registration. Prior to activation of your account, you are required to submit a valid proof of identification and proof of current residential address in compliance with AML-CFT 2009 of New Zealand. Only one registration is allowed for each person. If a duplicate record is found for the same person, we reserve the right to cancel one or both registrations without prior notice.
Remittance Request. Only a registered member of the Service is allowed to submit a remittance request. Each request must contain relevant and accurate information pertaining to the sender, the recipient, method of pay-out, remittance amount and service fees. If necessary, a request may also be accompanied by supporting documents showing source of funds. We may, at our sole discretion, decline or cancel any request from certain senders or to certain recipients with or without any reason. If certain request has already been paid in full, the full amount will be refunded to a nominated account of the sender within 10 working days from the time the request was declined or cancelled. The “Total Amount To Pay” or Transaction amount which is the remittance amount plus service fees automatically becomes due for payment upon confirmation and submission of remittance request. The Transaction amount must be paid in full and received in our nominated bank account in cleared funds within 24 hours of the request being submitted or until the next cut-off time of 12PM NZT, whichever comes first.
Mode of Pay-out. It refers to the manner by which the money will be paid-out to your intended recipient or beneficiary. The Service provides the following modes of pay-out: transfer to bank account and cash pick-up from our affiliated pick-up channels. For whatever mode of pay-out you choose, the information you provide must always be accurate and complete.
Service Fees. In consideration of your use of the Service, you agree to pay Pinoy Central a service fee for each remittance request you make. The fee becomes due and payable once a request is made and confirmed. Service fees are determined by the mode of pay-out selected and/or whether it is a transfer to a bank account with branch in Metro-Manila or in the province.
Payment. All payments must be made ONLY via online/internet banking deposits to our nominated bank account assigned to you. We do NOT allow over-the-counter deposits to any of our bank accounts. Any payments made by over-the-counter deposits will be refunded and will be charged of a $5 fee and any remittance request related to such payment will be cancelled. All payments must be identified using the Transaction ID of your remittance request. ONLY the Transaction ID of your remittance request must appear as reference, details or particulars in our bank statement. All payments must be received in our nominated bank account in cleared funds before the cut-off time of 12PM New Zealand time. If payment is not received within the next 24 hours of the request being submitted or until the next cut-off time, the remittance request may be cancelled on our discretion. In cases of any discrepancy between the Total Amount to Pay and the actual payment received, Pinoy Central reserves the right to adjust the amount to be transferred based on the actual payment received minus the service fee.
Delivery. We work with local banks and other third party remittance service providers in the Philippines to pay-out / transfer funds to your beneficiaries. Provided your payment is received on time, we will always endeavour to fulfil your remittance request and make reasonable effort for same-day processing but we make no guarantees that it will always be the case. The amount of time needed to complete processing a request is mostly depended on many factors outside our control. And so, once we have passed-on your request for further processing to our Philippine partners, the timeliness of the delivery of service is entirely on their hands.
As a registered user of the Service and as a condition of your use of the Service, you agree that you will:
a) be responsible for the maintaining the confidentiality of your membership account password;
b) keep your personal information updated at all times;
c) notify us immediately of any unauthorised use of your Pinoy Central’s account or any other breach of security. It is your responsibility to make sure that we have received your notification. We only act on notifications we have actually received from your registered email address;
d) not use the Service for any purpose that is unlawful, fraudulent, deceitful, untruthful, misrepresentative, dishonest or related in any manner to unlawful, unethical or morally questionable activities or is directly or indirectly related to the foregoing;
e) not tamper, hack, modify, frame, "deep link" or otherwise bypass or attempt to bypass security, functionality, entry points or any other features of the Services or the Web Site;
f) not directly or indirectly, either separately or as part of another service, agree to resell the Services;
g) abide by all applicable local, provincial, state, national and international laws and regulations;
h) not use the Service for any purpose otherwise prohibited by these Terms;
i) always remit funds only to persons that you know personally; and
j) cooperate with Pinoy Central to investigate any suspected unlawful, fraudulent or improper activity.
Pinoy Central is a New Zealand based money transfer service and therefore, adheres and complies with the Anti-Money Laundering and Counter Financing of Terrorism Act of 2009. It takes seriously its obligations to facilitate the investigation or prosecution of money laundering and terrorist financing offences pursuant to the Act. The Pinoy Central system has been designed and developed to automatically detect whether a transaction or person is suspicious or not by comparing a transaction against common patterns of money laundering and verifying a person’s name against the Specially Designated Nationals and Blocked Persons List (SDN list) of the Office of Foreign Assets Control (US-OFAC).
Pinoy Central system automatically collects and stores information every time you submit a remittance request online. Collection of this information is necessary to facilitate the efficient processing of your remittance request. Any Personal Information we have on you will not be used or disclosed to anyone unless we are requested or required by the police or any regulatory or government authority investigating suspected illegal activities, or we are instructed by the court upon receipt of a court order. We may, from time to time, use your contact information such as your email address and mobile phone number to inform you of products, services and promotions offered by us or by a third party.
In compliance with the AML-CFT Act of 2009, we are required to retain your information for a period of five (5) years from the date of your last remittance. Once the prescribed period has passed, Pinoy Central will see to it that all information related to your personal records and all related transactions will be deleted permanently from our database.
The Website contains copyrighted material, trade-marks and other proprietary and in some circumstances confidential information of Pinoy Central Portal and others (collectively "Proprietary Material"), which may include, but shall not be limited to: text, software, photos, video, graphics, images, music, software and sound. All Proprietary Material is owned by Pinoy Central and its licensors and is protected by applicable intellectual property rights including copyright, patent and trade-mark legislation and treaties. You agree not to modify, publish, copy, transmit, register or claim title to, participate in the transfer or sale of, create derivative works of, or in any way exploit, in whole or in part, any Proprietary Material except for copying that occurs in the ordinary course of browsing the Internet and personal copies of Web Site information that you make for your personal use including for your own records. You agree to respect any copyright, trade-mark, patent and other proprietary rights contained in any Proprietary Material on the Web Site. The only rights that you can have in Proprietary Material outside of these Terms are those granted in writing by Pinoy Central.
Pinoy Central makes no representations or warranties of any kind about the suitability, reliability, availability, timeliness, or accuracy of the service or the website for any purpose. The service is provided on an “as is” and “as available” basis. Pinoy Central hereby disclaims all warranties and representations with regard to the service, including all implied warranties and representations of merchantability, fitness for a particular purpose, title and non-infringement. Without limiting the generality of the foregoing you acknowledge and agree that Pinoy Central:
a) does not represent or warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service, or the servers that make it available, are free of viruses or other harmful components;
b) does not represent or warrant that the use or the results of the use of the Service will be correct, accurate, timely, or otherwise reliable;
c) shall not be responsible for unauthorised access to or alteration of your transmissions or data, any material or data sent or received or not sent or received, or any transactions entered into through the Service;
d) shall not be responsible for any loss due to payments to unintended users due to the input by you of incorrect information or for payments in incorrect amounts; and
e) cannot verify the identity of remittance beneficiaries which is your sole obligation in any remittance request.
In no event will Pinoy Central, its affiliates, agents, licensors, directors officers or employees, be liable to any party for any direct, indirect, special or other consequential damages or any other damages whatsoever including, without limitation, damage for loss of data, arising out of or in any way connected with the use or performance of the service or the website, with the delay or inability to use the service or website, the provision of or failure to provide services, or for any information, software, products or services obtained through the service, or otherwise arising out of the use of the service, whether based on contract, negligence, strict liability or otherwise. Pinoy Central may make changes or improvements to the information displayed on this website, or to the products or services described herein, at any time, without notice.
In no event shall the total liability of Pinoy Central to you for all damages in any one or more cause of action exceed NZ$500.00.
You agree to indemnify, defend and hold Pinoy Central, its affiliates, directors, officers and employees, harmless from any loss, claim, demand, or damage (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, including reasonable lawyers’ fees, sustained, incurred or paid by Pinoy Central and due to or arising out of your use of the Service or your conduct on the website or due to any transactions or activities that you otherwise engage in with any third party. Pinoy Central further reserves the right to report any wrongdoing that we become aware of to any government agency.
By accepting these Terms, you have consented that Pinoy Central will only provide you information and all communications by electronic means or in electronic forms. We are in no obligation to provide you any communication in paper form and for purposes of applicable laws, any electronic communication we send you shall be deemed “in writing”. You may withdraw your consent to receive communications electronically, but if you do, your use of the Service shall be terminated. In order to withdraw your consent, you must contact us using our contact information found in the Contact Us page of the site. In order to have access and retain communications with the Service, you must have the required hardware and software capable of accessing the site via the internet.
These Terms shall be governed according to the laws of New Zealand, and all activities performed in connection with the Service shall be deemed to have been performed in New Zealand. In the event of any controversy, dispute, or claim arising out of or relating to the Service or Terms, any proceedings shall be held in the courts of Auckland City, New Zealand.
